Shadow Jury Services

shadow-juryA Shadow Jury is an important and yet often overlooked tool in Jury Consulting.  A Shadow Jury is retained to provide the Trial Team with concurrent and ongoing feedback during trial.  Imaging Presentation Partners’ Jury Consultants utilize “Shadows” in the courtroom to assess how the actual jury is reacting to the presentation of testimony and evidence. 

The many benefits of Shadow Juror feedback include identification of:

Testimony that requires additional explanation;
The key witness’ impact on the case;
Resonating themes;
Ineffective strategies;
Central juror concerns; and
General favorability and leanings.

Much like actual jurors, Shadows are laypeople, who are jury-eligible, hired to attend court daily and observe trial.  Unlike actual jurors, Shadows are interviewed at the end of each court day by an IPP Jury Consultant who utilizes their feedback to identify hits and misses in the Trial Team’s presentation. 

We integrate Shadow Jury monitoring seamlessly into the courtroom, without disruption to or attention from the actual proceeding.  The Jury Consultant serves as both the conduit of the feedback and the intermediary between Shadow Jury and Trial Team.  The Shadow feedback is distilled by the consultant and reported to the Trial Team daily.  The Shadow Jury methodology, as performed by Imaging Presentation Partners, provides the Trial Team the benefit of helpful feedback while sparing it from spending significant time or resources in acquiring it.

The Trial Team gains real-time insight into the potential concerns, confusion and issues the sitting jury may be experiencing.  The Trial Team can then use the feedback to structure the following day’s examinations. 

A Shadow Jury may be used in a variety of matters, but is of particular value in Intellectual Property cases and matters that deal with highly complex and/or unfamiliar subject matters.  A Shadow Jury is also valuable in high-stake cases, such as anti-trust and mass tort litigation.
